Terms of Service

Please read these terms of business carefully and clarify with DS Gardening Services any items you are unsure of prior to work commencing.

1. Materials

1.1 All materials remain property of DS Gardening Services until paid for in full

1.2 Materials delivered to site become the responsibility of the Client and DS Gardening Services accepts no loss, damage or expense after delivery of the materials to site for any reason.

1.3 All materials brought to site, which prove to be in, excess to DS Gardening Services requirements shall remain the property of and shall be removable by DS Gardening Services who shall have the right to enter the site for that purpose.

1.4 Ds Gardening Services shall not be liable for any loss or theft of materials from site. Any additional materials required following damage, loss or theft shall be at the Client’s expense

2. Quotes

2.1 Quotes are valid for 30 Days

2.2 The quotation is based on conditions known at the time of viewing. The client will pay any extra works, or costs due to unknown difficulties or changes, which are not within the estimate.

3. Payment

3.1 Payments terms terms strictly 7 days from date of invoice.

3.2 DS Gardening Services reserve the right to charge interest on late payments set at 5%

4. Site

4.1 DS Gardening Services accepts no liability for damage to utilities unless the position of said utilities is clearly marked on a site plan.

4.2 The responsibility for the proper maintenance of the site passes to the Client upon completion of the Works unless otherwise agreed in writing.

4.3 The term waste removal refers only to waste produced by DS Gardening Services, it excludes disposal of any material otherwise on site.

4.4 The removal of litter or dog excrement from the site is the responsibility of the client.

4.5 The client shall be responsible for ensuring the safety of their children, family members, pets, animals and visitors at all times whilst work is being carried out on their premises.

4.6 DS Gardening Services shall be free from any liabilities, structural or accidental, when using machinery, except for accidents caused by improper use

5. Complaints

5.1 Any disputes / grievances must be received in writing to DS Gardening Services within 7 days of work completion for consideration.

6. Delays or Disruption

6.1 DS Gardening Services undertakes to use all reasonable endeavours to complete the work within a reasonable time or by a specified date if agreed. Under no circumstance shall DS Gardening Services incur any liability to the Client for any untimely performance or delays arising from force majeure, adverse weather conditions or events beyond his reasonable control.

7. Cancellation

7.1 We may at any time without cause cancel this agreement as a whole giving notice by email to the extent reasonably practicable. If we have to rearrange due to the weather or delays caused by a third party i.e. suppliers of materials We will offer you alternative dates to carry out the Services.

7.2 Following cancellation of this agreement: Accrued rights and liabilities are unaffected. All clauses in this agreement, which are stated or intended to continue after cancellation, will continue to apply.

7.3 If you the client wishes to cancel DS Gardening Services must receive notice of this 7 days prior in writing.
